Only in recent years has military diversion for DUI in California become an option, and I’ve taken advantage of this for many of my veteran clients. Typically, military diversion is going to mean a couple years of counseling or therapy, DUI school, following the instructions of the VA which may include medication, and providing written updates from the VA showing that the veteran is following all of the requirements. The fines are lower vs. a DUI, but there are a lot of hoops to jump through in order to avoid a DUI conviction. Avoiding such a conviction is a huge deal when it comes to finding employment and housing, maintaining good credit, and so many other things.

The new diversion statute under Penal Code Section 1001.95 is separate from military diversion; it applies to regular DUIs and diversions under this section have been granted in Marin, San Francisco, Alameda, and Sonoma Counties. In many cases, we might try to obtain a regular diversion first, and if unsuccessful, then we would take the military diversion route. However, this decision would depend on whether the defendant wants to take the VA route to begin with, so it would be made on a case-by-case basis.
